What is the Title IX Law?

Title IX is a federal civil rights law passed in 1972 as part of the Educational Amendments. The law was passed as a follow-up to The Civil Rights Act of 1964, which did not include sex as a protected class.

Title IX prohibits discrimination based on sex in any educational program or activity that receives federal funding. The law states:

“No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance.”

Title IX and Sports

While many associate Title IX with protecting students against sexual violence, its protections also extend to student-athletes. Since athletic programs are considered activities tied to federal assistance, Title IX applies. Schools and educational institutions are required to provide equal access to participation, scholarships, and the “laundry list” of program components, including:

  • Equipment and supplies
  • Scheduling of games and practice times
  • Travel and daily allowance/per diem
  • Access to tutoring
  • Coaching
  • Locker rooms, practice, and competitive facilities
  • Medical and training facilities and services
  • Housing and dining facilities and services
  • Publicity and promotions
  • Support services
  • Recruitment of student-athletes
